Susana A. Duarte is an Associated Partner at Abreu Advogados, working primarily on advising companies in restructuring operations and tax litigation in connection with different taxation maters.

She is particularly active in corporate tax matters, stamp duty and international taxation, in particular assisting companies to move to Portugal, and financing.

Susana has in-depth knowledge of OECD legislation and guidelines on transfer pricing, and assists in the organisation of transfer pricing documentation processes for multinational companies.

She also has experience in advising individual clients and family-owned business groups on tax matters and asset structuring, ensuring the generation transfer thereof, and also in tax litigation proceedings related to tax benefits, transfer pricing, and deductibility of financial costs in restructuring operations. She teaches taxation modules in advanced training courses and has published several articles on taxation.

Advising a multinational health sector company in several tax arbitrations related to the deductibility of financial charges in restructuring and merger operations;

Advising family-owned business groups in various tax litigation proceedings related to the application of the general anti-abuse clause to corporate restructuring operations;

Advising multinational insurance and energy distribution groups in various tax litigation procedures and proceedings relating to the recovery of taxes withheld in Portugal in violation of EU law;

Advising a multinational automotive company in various tax litigation procedures and proceedings related to its transfer pricing policy, including the application of the Arbitration Convention for the elimination of international double taxation, with deductibility and tax benefits carry-over;

Advising several multinational groups on financing structuring and intra-group financing, and tax litigation related to stamp duty in cashpooling contracts;

Advising a banking group in corporate tax litigation proceedings, in particular with regard to provisions set up under the discipline imposed by Banco de Portugal;

Advising various technological companies on corporate tax matters, namely on issues related to their implementation in Portugal;
