José Maria Alves Pereira is a senior associate lawyer and has been at Abreu Advogados since 2017, working mainly in the areas of intellectual property and information technology.

José Maria has extensive practical experience on matters relating to the General Data Protection Regulation (“GDPR”), including Data Processing Agreements, advice on regulatory matters, as well as drafting and reviewing privacy notices.

He has also provided assistance on how to respond to data breaches (including drafting data breach notifications, and data breach reports), in addition to assessing the level of compliance of new challenging projects, as well as providing on-going advice.

Additionally, José has a vast experience in the areas of
e-commerce, consumer law, media, advertising, information technology and the internet, on matters such as compliance projects regarding growing technologies, software development agreements, e-commerce platforms, cybersecurity issues, and providing advice with regard to advertising activities (online and offline).

Furthermore, José has also participated in complex M&A operations, namely within the areas of industrial property, data protection and information technologies.

His experience includes advising leading international and local companies across the technology, healthcare, food, retail and automotive industries with their compliance projects (on all stages of their development).

José Maria is an Irish Computer Society Certified Data Protection Practitioner.

Experience

Conducting full data protection projects for multinational companies, within which the following are highlighted: international medical diagnostics provider with laboratory services; major international car manufacturers; international major food retailer;

Conducting data protection impact assessments about employee monitoring tools;

Participation in several M&A operations in the area of industrial property, data protection and information technologies for multinational companies;

Provide advice on administrative processes related to data protection (namely with regard to E-Privacy issues, and exercise of data subject rights);

Provide advice on administrative and judicial proceedings related to industrial property;

Provide assistance with the set-up of Non-Fungible Tokens (NFTs) projects. The assistance covered data privacy aspects, as well as e-commerce, and IP issues;

Provide advice to an American multinational technology company with regard to international data transfers;

Provide assistance on how to respond to data breaches (on a local, and EU level);

Provide on-going assistance to an American multinational technology company within the following subjects: E-commerce (in particular focus on E-Commerce Safe Harbor issues), Data Protection (e.g. exercise of data subjects rights; E-Privacy issues);

Provide assistance to a major food retailer with its cyber security program.
